When Amazon built an AI recruitment tool trained on a decade of internal hiring data, it taught the system to replicate a pattern in which men dominated tech roles. The tool began penalizing resumes that included the word "women's" — as in women's college, women's leadership fellowship. The tool was retired. But the question it raised has not been answered: how many organizations are running a version of that system right now, without knowing it?

A 2025 study published in Nature and reported by Stanford University found that when large language models including ChatGPT were asked to generate resumes for hypothetical female candidates, they consistently portrayed women as younger and less experienced than men. When those same models rated the resumes, older men received higher scores than older women with identical qualifications. The researchers analyzed over 1.4 million data points across Google, Wikipedia, IMDb, and YouTube, and found these distortions were not glitches. They reflected a culture-wide pattern that AI had absorbed and was now amplifying at scale.

The Stanford HAI 2025 AI Index Report confirmed that the problem persists even inside models designed to prevent it. Leading large language models — including those built with explicit fairness measures — continue to associate women with the humanities over STEM fields and to favour men for leadership roles in their outputs. The report is direct: although bias metrics have improved on standard benchmarks, AI model bias remains a pervasive issue.

The damage compounds outside hiring. Apple's credit card algorithm offered dramatically lower credit limits to women than to their male spouses, even when the women held stronger financial profiles. In healthcare, a 2025 study found that AI tools framed women with complex conditions as more independent and less in need of support than men with equivalent diagnoses — a distortion researchers warned could lead systems to under-allocate care for women. The UC Berkeley and University of Chicago research exposing racial bias in healthcare algorithms showed that when bias intersects with gender and race, the harm multiplies. The Legal and Business Stakes Are Real

The legal landscape in North America is tightening — and Canadian businesses are not exempt. In Ontario, the Workers for Workers Four Act takes effect in 2026, making Ontario the first province to legislate AI transparency in hiring: employers must now disclose when AI is being used to screen or assess job candidates in publicly advertised postings. That same month, Ontario's Information and Privacy Commissioner and the Ontario Human Rights Commission jointly released six principles for responsible AI use, including an explicit requirement to check for bias and discrimination in AI systems and data. At the federal level, Canada's proposed Artificial Intelligence and Data Act died on the Order Paper when Parliament was prorogued in early 2025 — but that doesn't mean businesses are off the hook. The Canadian Human Rights Act already applies: AI systems that produce discriminatory outcomes in hiring, housing, or service delivery can lead to orders for damages and corrective measures under federal and provincial human rights codes.

South of the border, the regulatory pace is faster. New York City's Local Law 144 requires companies using AI in hiring to commission an independent bias audit every year and publish the results. California has passed laws taking effect in 2026 covering transparency requirements for generative AI and data retention rules for hiring decisions. New York State is advancing legislation — Senate Bill S7263, which cleared committee unanimously in early 2026 — that would make chatbot operators legally liable when their tools dispense professional advice that only a licensed human should provide. Disclosing that a tool is powered by AI does not shield operators from liability. Taken together, these developments signal that regulators on both sides of the border are moving from broad principles to specific, enforceable accountability — and businesses that have not audited how their AI tools behave are already behind.

The Governance Gap: People Know, But They Are Not Acting

There is a massive disconnect between what leaders say and what they do. An IBM study found that nearly half of CEOs are concerned about AI bias. However, 74 percent of companies using AI have not taken actual steps to reduce bias. Sixty percent have no ethical AI policy at all.

On the privacy side, 68 percent of privacy professionals are now also handling AI governance. But 99 percent of organizations plan to shift money away from privacy budgets and into AI projects. They are stretching their teams thinner at exactly the moment when the pressure is growing.

1. Start with the data. Know exactly what data is being collected and why. Ensure training data is representative of the populations the system will affect. Look for patterns of historical bias before building or implementing any tool. Skewed inputs produce skewed outputs, and those outputs will carry the fingerprints of every inequity in the original dataset.

2. Run regular audits. Test AI results across demographic groups to surface unfair outcomes before they cause harm. Bias can shift as models evolve and business contexts change. An audit that happens once at launch is not an audit — it is a formality.

3. Give someone real authority. Establish oversight with the power to pause or change an AI system when it crosses a line. If the people responsible for governance cannot act, the governance is meaningless.

4. Keep humans in the loop. For decisions that affect livelihoods — hiring, lending, healthcare — a person must be involved and must have the authority to override the machine when it gets things wrong. Automation should accelerate good judgment, not replace it.

5. Be transparent about it. Tell people when AI is being used and what data is involved. Organizations that get ahead of transparency expectations do not just avoid fines. They build the kind of trust that is increasingly difficult to earn and very easy to lose.

Why AI Literacy Is a Survival Strategy

The question is not whether AI is powerful. The question is who is in control of it.

Too many professionals treat AI as something that belongs to technical experts, and waiting feels safer than engaging. It is not.
